By registering on the online learning portal operated by Vethathiri Maharishi College of Yoga (VMCY), a unit of The World Community Service Centre (WCSC), you agree to be bound by the following Terms of Use.
1. Registration and User Account
As the original purchaser or authorized participant of the course/content offered by Vethathiri Maharishi College of Yoga, you are entitled to access and use the course content identified in the course for which you have registered or enrolled.
To access the course content, you are required to register using your valid email ID and create a password for accessing the online learning platform.
Your password and user account are personal, unique, and exclusive to you. You shall not share, transfer, assign, sell, or otherwise permit any other person to use your account, password, or course access.
You agree to immediately notify Vethathiri Maharishi College of Yoga if you become aware of any unauthorized use of your account or password.
VMCY reserves the right to suspend, restrict, or permanently revoke your access to the course or portal if your account is misused or if you violate these Terms of Use. In the event of such suspension or revocation due to violation of these Terms, you shall not be entitled to any refund or other compensation.
2. Acceptance of Terms
These Terms of Use govern your access to and use of the VMCY online learning platform and all course materials, content, videos, documents, assessments, recordings, study materials, and other resources made available through the platform.
By registering for, accessing, or using the platform, you acknowledge that you have read, understood, and agreed to these Terms of Use.
If you do not agree with any provision of these Terms, you must not register for, access, or use the platform or its content.
Vethathiri Maharishi College of Yoga reserves the right to modify, amend, update, or revise these Terms of Use at any time. Continued use of the platform after such changes shall constitute your acceptance of the revised Terms.
3. License to Access Course Content
Upon successful registration/enrolment, VMCY grants you a limited, personal, non-exclusive, non-transferable, non-assignable, and revocable license to access and use the course content for your personal educational and learning purposes.
The course content is licensed to the registered participant only and does not constitute a transfer of ownership of any intellectual property or copyrighted material.
You shall not:
- Share your login credentials with any other person.
- Allow another person to attend classes or access course content using your account.
- Copy, reproduce, record, download, distribute, publish, transmit, or commercially exploit course materials without prior written permission.
- Upload course materials to social media, websites, cloud storage, messaging groups, or other platforms.
- Sell, sublicense, transfer, or otherwise make the course content available to any third party.
- Use the course content for commercial training, teaching, coaching, or business purposes without written authorization from VMCY.
4. Course Content and Availability
VMCY reserves the right to modify, update, replace, suspend, or remove any course, lesson, video, document, recording, assessment, or other content available on the platform.
VMCY may also temporarily suspend or permanently discontinue the online learning platform or any portion thereof for administrative, technical, academic, security, or other reasons.
VMCY shall make reasonable efforts to maintain the availability of the platform and course content. However, VMCY shall not be responsible for interruptions caused by internet connectivity, technical failures, equipment or software incompatibility, maintenance, third-party service providers, natural disasters, governmental restrictions, or other circumstances beyond its reasonable control.
Removal of content, modification of a course, suspension of access, or discontinuation of the platform shall not automatically create an entitlement to a refund, compensation, or other payment, except where specifically required by applicable law or expressly provided in the applicable course/refund policy.
5. Prohibition of Automated Access
You agree not to use any automated system, including but not limited to robots, spiders, crawlers, scrapers, bots, offline readers, or similar technologies, to access, copy, collect, monitor, or reproduce content from the VMCY platform without prior written authorization.
6. No Commercial Use
The platform and its contents are provided for personal educational and learning purposes.
You shall not use any course material, video, lecture, presentation, document, recording, photograph, assessment, or other content for commercial purposes, including but not limited to:
- Commercial teaching or training;
- Paid workshops or classes;
- Marketing or promotional activities;
- Selling or licensing course materials;
- Reproducing or distributing course content for monetary benefit; or
- Providing access to course content to paying or non-paying third parties.
Any such use requires prior written authorization from Vethathiri Maharishi College of Yoga.
7. Disclaimer of Warranties and Limitation of Liability
Your use of the online platform and course content is at your own risk.
To the fullest extent permitted by applicable law, VMCY provides the platform and its content on an “as is” and “as available” basis, without warranties or representations, express or implied.
VMCY does not warrant that:
- The platform will always be available or uninterrupted;
- The platform will be completely error-free;
- All technical errors will be corrected immediately;
- The content will always be available in its current form; or
- The platform or its servers will always be free from viruses or other harmful components.
To the fullest extent permitted by law, VMCY, its management, officers, employees, faculty members, instructors, representatives, and authorized personnel shall not be liable for any direct, indirect, incidental, special, consequential, or other damages arising from or relating to your use of the platform or course content.
8. Indemnification
You agree to indemnify, defend, and hold harmless Vethathiri Maharishi College of Yoga, The World Community Service Centre, their management, officers, employees, faculty members, instructors, representatives, and authorized personnel from and against any claims, losses, damages, liabilities, costs, expenses, judgments, or legal proceedings arising from:
- Your misuse of the platform;
- Your violation of these Terms of Use;
- Unauthorized use or distribution of course content;
- Your violation of any applicable law or regulation; or
- Any action or omission by you that causes harm to VMCY or any third party.
9. Limitation Period
To the extent permitted by applicable law, any cause of action arising out of or relating to the VMCY platform, course content, or your use of the platform must be commenced within one (1) year from the date on which the cause of action arose, unless a longer period is required under applicable law.
10. Entire Agreement and Severability
These Terms of Use constitute the entire agreement between you and Vethathiri Maharishi College of Yoga concerning your use of the online learning platform and course content, unless otherwise specified in a separate written agreement or applicable course policy.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to remain valid and enforceable.
11. No Waiver
Failure by Vethathiri Maharishi College of Yoga to enforce any provision of these Terms of Use shall not constitute a waiver of that provision or of any other rights under these Terms.
A waiver of any provision shall be effective only if expressly made in writing by an authorized representative of VMCY.
PERSONAL LIABILITY WAIVER AND YOGA PRACTICE DECLARATION
I understand that participation in yoga classes, courses, workshops, practical sessions, demonstrations, assessments, and other activities offered by Vethathiri Maharishi College of Yoga, whether conducted in person or through online mode, involves physical activity and may involve inherent risks.
I understand and agree that it is my responsibility to inform the faculty member or instructor about any physical limitations, injuries, health concerns, or other circumstances that may affect my ability to participate safely before the commencement of the class or activity.
I understand that I should consult a qualified medical professional before participating in yoga classes or other physical activities if I have any medical concerns or conditions that may affect my participation.
I agree to follow the instructions, safety guidelines, and directions given by the faculty members, instructors, and authorized representatives of Vethathiri Maharishi College of Yoga.
I acknowledge that I am responsible for participating within my own physical limitations and for stopping or modifying an activity if I experience pain, discomfort, dizziness, or any other concerning symptoms.
WAIVER AND RELEASE
To the extent permitted by applicable law, I hereby waive and release Vethathiri Maharishi College of Yoga, The World Community Service Centre, their management, officers, employees, faculty members, instructors, representatives, and authorized personnel from claims arising from my voluntary participation in yoga classes, workshops, practical sessions, activities, or programs, except to the extent such liability cannot lawfully be excluded.
I understand and acknowledge that I am responsible for the risks associated with my participation in yoga classes, workshops, practical sessions, and other activities, including risks that may be known or reasonably foreseeable.
I further agree to follow all safety instructions and to inform the instructor immediately if I experience any difficulty, discomfort, injury, or other condition during a session.
Photographs, Videos and Testimonials
I understand that Vethathiri Maharishi College of Yoga or The World Community Service Centre may photograph, record, or otherwise document educational programmes, workshops, events, classes, testimonials, feedback, and related activities.
To the extent permitted by applicable law, I consent to the use of my photographs, videos, statements, testimonials, feedback, or other recordings for legitimate educational, institutional, documentation, archival, promotional, or awareness purposes by VMCY/WCSC, unless I have expressly withdrawn such consent in writing where withdrawal is legally applicable.
I understand that I shall not be entitled to any monetary benefit, royalty, or compensation arising from such permitted use.
I confirm that I have read and understood this Personal Liability Waiver and agree to its terms voluntarily.
I further confirm that I am legally competent to provide this consent and agree to participate responsibly and mindfully in the programmes offered by Vethathiri Maharishi College of Yoga.
Please practice mindfully, follow the guidance of your instructor, and enjoy the benefits of yoga practice.
COPYRIGHT AND INTELLECTUAL PROPERTY UNDERTAKING
I acknowledge that all course materials and intellectual property provided by Vethathiri Maharishi College of Yoga and/or The World Community Service Centre are protected by applicable copyright and intellectual property laws.
I undertake to respect and protect the intellectual property rights of VMCY/WCSC and agree that the course materials are provided to me solely for my personal educational and learning purposes.
I agree that I shall not, without prior written permission from VMCY/WCSC:
- Copy or reproduce course materials;
- Record online or offline classes;
- Screenshot or reproduce substantial portions of course materials;
- Share videos, audio recordings, presentations, notes, books, PDFs, question papers, assessments, or other materials with third parties;
- Upload or distribute course materials through WhatsApp, Telegram, YouTube, Facebook, Instagram, websites, cloud storage, or other platforms;
- Sell, publish, sublicense, or commercially exploit the course materials;
- Teach or conduct commercial programmes using the proprietary course materials; or
- Disclose, describe, reproduce, or explain the proprietary course content to any third person in a manner that infringes the intellectual property rights of VMCY/WCSC.
I undertake to use the knowledge and learning acquired through the course primarily for my personal development, education, and lawful professional purposes, subject to the applicable course and certification requirements.
Any unauthorized reproduction, distribution, recording, publication, or commercial use may result in suspension or termination of course access and may also lead to appropriate legal action under applicable law.
DECLARATION AND ACCEPTANCE
By selecting “I Agree”, “Accept Terms & Conditions”, or by registering for/accessing the course, I confirm that:
- I have read and understood these Terms of Use.
- I agree to comply with all applicable terms, rules, and instructions of Vethathiri Maharishi College of Yoga.
- I understand that my account and course access are personal and non-transferable.
- I agree not to share or distribute course materials without authorization.
- I understand the Personal Liability Waiver and agree to participate responsibly.
- I agree to respect the copyright and intellectual property rights of VMCY/WCSC.
- I confirm that the information provided by me during registration is true and accurate.
- I voluntarily accept these Terms and Conditions.
